Our offerings are designed for business-to-business (B2B) use, and we do not market, sell, or otherwise direct our products or services to individuals acting in a personal or household capacity. Advertising, Marketing, Cookies, and Other Tracking Technologies Choices 

• Cookies and other tracking technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. You can choose whether to allow the Site to collect information through other tracking technologies by making the selection in our consent management platform. If you disable or refuse cookies or similar tracking files, some Site features may be inaccessible or not function properly. Some browsers include a Do Not Track (“DNT”) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Site may not respond to all browser DNT signals. To the extent feasible and required by state law, depending on your state, data will be provided in a portable format. Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data “sales” as defined under certain laws. International

We are located in the United States. We target our Site to businesses and their personnel in the United States. The Personal Data that we collect are stored on servers hosted by us or our authorized third-party service providers located in the United States and elsewhere. This means that your Personal Data will be collected, processed, and stored in the United States or other countries, which may have data protection laws that are different from (and sometimes less protective than) the laws of your country or region.

By sending us Personal Data, you agree and consent to the processing of your Personal Data in the United States, which may not offer an equivalent level of protection to that required in other countries (particularly the European Union), and to the processing of that information by us on servers located in the United States, as described in this Privacy Policy.

This CCPA Notice for California Residents (“California Privacy Notice”) describes how Jayhawk  Fine Chemicals (collectively, “Jayhawk,” “Company,” “we,” or “us”) collect and process Personal Data about individuals who reside in California. Disclosing, Selling, or Sharing Personal Data

Business Purpose Disclosures

We may disclose the Personal Data we collect to third parties for the business purposes described in the How We Use Your Information section in the Privacy Policy and in the table below, such as to engage third parties/service providers and contractors to support our business functions. For example, we may disclose information from your visits to the Company’s website to a cybersecurity consultant to help secure your address to our shipping carrier to deliver your order.  

We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the Personal Data confidential, prohibit using the disclosed information for any purpose except performing the contract, and meet the CCPA’s other contract requirements for engaging service providers or contractors.

We do not sell or share your Personal Data to third parties and have not sold or shared them in the preceding twelve (12) months for monetary consideration. Given the broad definition of sales or sharing, we may sell or share your Personal Data with third parties for cross-context behavioral advertising purposes via cookies, pixels or other trackers on the Site. 

Our Personal Data sales and/or sharing does not include information about California residents we know are under age sixteen (16).

Right to Know and Data Portability Requests

You have the right to request that we disclose certain information to you about our collection and use of your Personal Data (the “Right to Know”), including the specific pieces of Personal Data we have collected about you (a “Data Portability Request”). Our response will cover the twelve (12) month period preceding the request, although we will honor requests to cover a longer period, unless doing so would be impossible or involves disproportionate effort. You may exercise your right to know twice in any twelve (12) month period. 

Once we receive your request and confirm your identity (see How to Exercise Your Rights), we will disclose to you the categories of:

• Personal Data we collected about you
• sources from which we collected your Personal Data
• the business or commercial purpose for collecting your Personal Data and, if applicable, selling or sharing your Personal Data
• if applicable, the categories of persons, including third parties, to whom we disclosed your Personal Data, including separate disclosures identifying the categories of your Personal Data that we:

• disclosed for a business purpose to each category of persons
• sold or shared to each category of third parties

When your right to know submission includes a data portability request, we will provide a copy of your Personal Data, subject to any permitted redactions.

As we do not use automated decision-making, we do not currently provide California residents right to access automated decision-making.

Right to Delete and Right to Correct

You have the right to request that we delete any of your Personal Data that we collected from you and retained, subject to certain exceptions and limitations (the “Right to Delete”). Once we receive your request and confirm your identity, we will delete your Personal Data from our systems unless an exception allows us to retain it. We will also notify our service providers to take appropriate action.

You also have the right to request correction of Personal Data we maintain about you that you believe is inaccurate (the “Right to Correct”). We may require you to provide documentation, if needed, to confirm your identity and support your claim that the information is inaccurate. Unless an exception applies, we will correct Personal Data that our review determines is inaccurate and notify our service providers to take appropriate action.

Right to Limit Sensitive Personal Data Use and Disclosure 

You have a right to ask businesses that use or disclose your sensitive Personal Data to limit those actions to just the CCPA’s permitted purposes (the “Right to Limit”). As we do not use or disclose sensitive Personal Data beyond the CCPA’s permitted purposes, we do not currently provide this right.

 

Personal Data Sales or Sharing Opt-Out and Opt-In Rights

You have the right to request that businesses stop the sharing of your Personal Data at any time (the “Right to Opt-Out”), including through a user-enabled opt-out preference signal. Similarly, the CCPA prohibits businesses from selling or sharing the Personal Data of California residents it actually knows are under sixteen (16) years old without first obtaining consent from California residents who are between thirteen (13) and fifteen (15) years old or the California residents’ parent or guardian for California residents under age thirteen (13) (the “Right to Opt-In”).

Verification Process and Authorized Agents

Only you, or someone legally authorized to act on your behalf, may make a request to know, delete, correct related to your Personal Data. We may request specific information from you or your authorized representative to confirm your or their identity before we can process your right to know, delete, or correct your Personal Data.  

We cannot respond to your request to know, delete, or correct if we cannot verify your identity or authority to make the request and confirm the Personal Data relating to you. We will only use Personal Data provided in the request to verify the requestor’s identity or authority to make the request.

You do not need to create an account with us to submit a request to know, correct, or delete.

For requests to opt-out, we ask for the information necessary to complete the request, which may include, for example, your name, or email address.

 

Responding to Your Requests to Know, Delete, or Correct

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the ten (10) day timeframe, please contact inquiry@jayhawkchem.com

We endeavor to substantively respond to a verifiable request within forty-five (45) days of its receipt. If we require more time (up to another forty-five (45) days), we will inform you of the reason and extension period in writing. We will deliver our written response to your verified email address. Our substantive response will tell you whether we have complied with your request. Response and Timing on Rights to Opt-Out

You do not need to create an account with us to exercise your opt-out rights.  We will only use Personal Data provided from your request to comply with the request.

We will also notify our service providers, contractors, and certain other downstream recipients of your request to opt-out and instruct them to both: 

• comply with your request
• forward the request to their own downstream recipients, if applicable

Once you make a request to opt-out, we will wait at least twelve (12) months before asking you to reauthorize the use or disclosure of your sensitive Personal Data for purposes other than the Personal Data sales or sharing.
